Important: 6Pulse is a consumer safety and monitoring service, not a medical device. It is not intended to diagnose, treat, or prevent any medical condition. Please read Section 6 (Health Disclaimer) carefully.
1. Acceptance of Terms
By purchasing a 6Pulse Device, creating an account, or using the 6Pulse mobile application or related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy, which is incorporated herein by reference.
If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you ("User," "you," or "your") and 6Pulse, Inc. ("6Pulse," "we," "our," or "us"). If you are using the Service on behalf of another person, you represent that you have authority to bind that person to these Terms.
2. Description of Service
6Pulse provides a passive, camera-free home monitoring system designed to help families stay informed about the safety and activity of elderly or at-risk individuals. The Service consists of:
- IoT sensor hardware (the "Device") that detects motion, presence, and potential falls in the home;
- A mobile application ("App") for iOS and Android that displays real-time activity data and receives alerts;
- Cloud infrastructure that processes sensor data, runs fall-detection algorithms, and manages notifications;
- Customer support and account management services.
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time. We will provide reasonable notice of material changes.
3. Device Purchase & Subscription
3.1 Device Purchase
The 6Pulse Device is sold as a one-time hardware purchase. Title to the Device transfers to you upon delivery. The Device is covered by a one-year limited hardware warranty against defects in materials and workmanship. This warranty does not cover damage caused by misuse, unauthorized modification, or normal wear and tear.
3.2 Subscription
Active monitoring, cloud processing, alerts, and App access require a paid monthly subscription. Your subscription begins on the date you activate the Device and renews automatically each month until cancelled. You may cancel at any time from the App settings; cancellation takes effect at the end of the current billing period. We do not offer refunds for partial billing periods.
3.3 Pricing Changes
We reserve the right to change subscription pricing with at least 30 days' advance notice. Price changes will not apply until your next renewal after the notice period.
4. User Accounts
You must create an account to use the Service. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to:
- Provide accurate and complete information when creating your account;
- Promptly update your account information if it changes;
- Notify us immediately at contact@6pulse.io if you suspect unauthorized access to your account;
- Not share your account credentials with anyone outside your immediate family unit.
We reserve the right to suspend or terminate accounts that we reasonably believe are being used in violation of these Terms.
5. Acceptable Use
The Service is intended to support the safety and well-being of the monitored individual with their knowledge and, where appropriate, consent. You agree that you will not use the Service to:
- Monitor any person without their knowledge and reasonable consent;
- Use monitoring data to harass, intimidate, or harm any individual;
- Attempt to reverse-engineer, decompile, or tamper with Device firmware or App source code;
- Interfere with or disrupt the security or performance of our servers or networks;
- Use the Service for any unlawful purpose or in violation of any applicable regulation;
- Resell, sublicense, or commercially redistribute the Service without written authorization from 6Pulse.
6. Health Disclaimer
6Pulse is NOT a medical device. The Service has not been evaluated, cleared, or approved by the U.S. Food and Drug Administration (FDA) or any equivalent regulatory body. It is not intended to diagnose, treat, cure, monitor, or prevent any disease or medical condition, including cardiovascular disease, neurological conditions, or injury.
Fall detection and activity monitoring provided by 6Pulse are based on statistical algorithms and will not detect every fall or every emergency. False negatives (missed events) and false positives (incorrect alerts) will occur. You should not rely on 6Pulse as the sole means of emergency response or health monitoring.
6Pulse is intended as a supplemental awareness tool. In any medical emergency, call 911 (or your local emergency services) immediately. If the monitored individual has serious health conditions, consult a licensed healthcare professional about appropriate monitoring and emergency response plans.
7. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, 6PULSE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF LIFE, PERSONAL INJURY, PROPERTY DAMAGE, LOST PROFITS, OR DATA LOSS ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.
In particular, 6Pulse shall not be liable for any harm arising from: (a) a failure to detect a fall or emergency event; (b) a delayed or undelivered alert due to network interruptions, device malfunction, or incorrect configuration; (c) your reliance on the Service as a substitute for emergency medical services.
TO THE EXTENT 6PULSE IS FOUND TO BE LIABLE FOR ANY CAUSE WHATSOEVER, OUR AGGREGATE LIABILITY WILL NOT EXCEED THE GREATER OF (A) THE TOTAL FEES YOU PAID TO 6PULSE IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) $100 USD.
8. Intellectual Property
All content, software, hardware designs, algorithms, trademarks, and trade dress associated with the Service are the exclusive property of 6Pulse, Inc. or its licensors. These Terms do not grant you any license to use our intellectual property except as expressly provided.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App solely for your personal, non-commercial use in connection with the Service.
9. Termination
You may terminate your account at any time by cancelling your subscription and contacting us at contact@6pulse.io to request account deletion.
We may suspend or terminate your account immediately if we determine, in our sole discretion, that you have violated these Terms or that your use of the Service poses a risk to the safety of others or the integrity of our systems. Upon termination, your right to use the Service ceases immediately, and Sections 6, 7, 8, and 10 will survive termination.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may seek injunctive relief in a court of competent jurisdiction.
You agree that any arbitration will take place on an individual basis; class arbitrations and class actions are not permitted.
